Policy on Service Modification for Terminated Accounts

1. Purpose and Scope
This policy defines the actions Yama Industrials, Inc. reserves the right to take regarding the configuration of client-owned hardware following the termination of a Service Agreement ("Agreement") due to non-renewal or material breach, including non-payment of service invoices. This policy is incorporated by reference into the Main Service Agreement and the master Terms of Service available at resources.yamaindustrials.com .
2. Policy Statement on Removal of Proprietary Services
Yama Industrials, Inc. invests in and develops proprietary services and configurations, such as Yama DNS Protection, to provide enhanced security and performance to clients under an active, paid Service Agreement. These features are components of the subscription service and are not granted to the client in perpetuity.
In the event of the termination of a Service Agreement due to client non-payment, Yama Industrials, Inc. reserves the right to modify the configuration of the managed hardware to remove any and all proprietary, subscription-based services and features.
3. Specific Action Regarding DNS Services
To provide a specific example that falls under the policy stated in Section 2:
Due to the termination of the service agreement for non-payment, all proprietary and subscription-based security features will be removed from your firewall configuration. This includes the Yama DNS Protection service, which will be replaced with standard public DNS resolvers (e.g., 1.1.1.1, 8.8.8.8) to maintain basic internet connectivity.
This action is not punitive but is the logical and necessary cessation of a premium service for which payment is no longer being rendered.
4. Client Acknowledgment and Assumption of Risk
4(a) By failing to maintain a Service Agreement in good standing, the client acknowledges and accepts that the removal of these security features may increase their network's exposure to threats. The client assumes sole responsibility for any and all risks associated with the operation of their network without the proprietary security services previously provided by Yama Industrials, Inc.
4(b) Absolute Release of Liability
The client releases, waives, and forever discharges Yama Industrials, Inc., its officers, directors, employees, contractors, and agents from any and all claims, liabilities, damages, losses, costs, or expenses (including attorneys' fees) arising from or related to:
The removal of proprietary security features or subscription-based services
Network security incidents, data breaches, or cyberattacks occurring after service modification
System downtime, performance degradation, or connectivity issues
Business interruption, lost profits, or consequential damages
This release is absolute and applies regardless of the cause or theory of liability.
